What is Revenge Porn?

Revenge porn is a form of online harassment in which your nude photos and videos are distributed without your consent.  It is an epidemic.  And, unfortunately for victims of revenge porn, the photo or video is usually accompanied with the victim’s identifying information.

What should you know?

How do you handle revenge porn?  It is easy to caution victims about the importance of prevention, but that caution is futile once your private photos and videos are available on the Internet on social media platforms such as Facebook, Instagram, and Snapchat—for the viewing pleasure of just about everyone you know and thousands of people you don’t.  For couples that are considering getting married or are already married, prenuptial and postnuptial agreements that include social media and privacy clauses are certainly an option.  But, again, this doesn’t solve the issue of what happens when your photos are already publicly available on the world wide web.

Relief IS available for victims of revenge porn.  Many states have laws punishing revenge porn.  Which states?  Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Iowa, Kansas, Louisiana, Maine, Maryland, Michigan, Minnesota, Nevada, New Hampshire, New Mexico, North Carolina, North Dakota, Oklahoma, Oregon, Pennsylvania, South Dakota, Tennessee, and Texas.  In addition, your private information CAN be removed from the Internet.  Google and Bing will remove specific revenge porn from their search results if you inform them that you are the person depicted in the photo or video and that you did not consent to its publication.  Hutcherson Law regularly helps victims of revenge porn delist their private photos and videos from Google’s search results.

If you are a victim of revenge porn, Hutcherson Law can help you understand privacy laws and obtain the relief you seek – whether it is removal from search results or damages.
